KANAJE KENNELS
CONTRACT & HEALTH GUARANTEE
This Dog or Puppy is Guaranteed as follows:
1. To be a Purebred Yorkshire Terrier from an AKC and/or CKC registered litter, and such, to be registerable with AKC and/or CKC in the new owner’s name(s).
2. To be sound and free of communicable disease for a period of 3 days from date of purchase and free life threatening hereditary/genetic problems, that cause your puppy to expire, until one year of age. Because these conditions may be caused or exacerbated by environment and injury, luxating patellas, & skin allergies are not covered under this guarantee. Also, hernias, stenotic nares, cherry eye, over bites or under bites are not covered by this agreement. The buyer agrees to have dog checked within 3 days by his or her own veterinarian at their own expense.
3. The guarantee is void if the dog is sold or transferred to another owner or the dog is not vet checked within 3 days of purchase.
4. Under no circumstance will the purchase price of the dog/puppy be refunded. The breeder may replace any dog, should circumstances warrant replacement, such as, if a puppy is found to have a life threatening health problem, that causes your puppy to expire. The health problem must date
back to the pre-natal stage.
5. This breeder will provide replacement if the dog fails to live up to #’s 1 & 2 above. Replacement time and selection are up to the breeder, but will not be withheld unwarrantedly, or unreasonably. The dog to be replaced must be brought to the breeder, along with any medical records and findings from the buyers Vet, for evaluation before replacement. If the dog’s health is in question, the buyer agrees to have the dog checked by the D.V.M. of the breeder’s choice, at the expense of the buyer. The breeder will abide by the decision of the D.V.M..
6. In any replacement circumstance, registration papers are to be signed over and returned to the breeder along with the puppy for replacement.
7. All puppies are sold as pet quality with no guarantee of show quality or to breeding ability is expressed or implied, unless agreed upon in writing between buyer and seller. Breeder can not guarantee adult size, color or that males will have two normally descended testicles at maturity.
8. The seller assumes no responsibility for any medical expenses, mortality, landlord’s disapproval, allergy to dander or any other undesirable circumstance once the dog has left the seller’s premises. as left the seller's premises
9. If at any time in the future it becomes necessary for the buyer to “place/sell/give away” the puppy in a different home, the buyer agrees to return the puppy/dog to the breeder for re-homing purposes. This does not in any way obligate the breeder to refund the purchase price of the animal. However, the breeder does agree to take the puppy/dog and find a suitable home, without any expense to the breeder or the buyer. If the breeder can re-sell the puppy/dog, then all of the proceeds from that sale, except for a $100
re-homing fee, belong to the buyer.
10. Any puppy/dog obtained from KANAJE KENNELS is never to be placed at Humane Shelter, puppy mill, pet shop or a rescue shelter.
11. If #10 does occur, the buyer will be responsible for all cost incurred by the breeder to recover the puppy/dog.
Also, the breeder has the right to pursue and recover punitive damages from the buyer under these circumstances.
12. Any disputes, concerning this guarantee, will be litigated in Montgomery County, State of Alabama, at the buyer’s expense. Guarantees are non-transferable. If after litigation, the seller is found compliant according to this written guarantee, the buyer agrees to pay any expenses incurred by the seller, including but not limited to attorney fees.
